On this episode of the Real Estate Fight Club Podcast, Jenn and Monica are going to duke it out over, Is wholesaling illegal? What do you need to know about wholesaling? Jenn and Monica also talk about how real-estate agents get access to things that are good wholesaling products. Wholesaling can work on any house. It just depends on what the seller wants, says Jenn. Tune in.
Episode Highlights:
- As per Jenn wholesaling is not illegal and it shouldn't be illegal. Wholesaling is when you get a property under contract and then you sell that contract, and your commission is the spread. For example, you buy a property for $200,000. You sell the contract for more and then the difference is what you would make.
- In wholesaling you charge an assignment fee, and you assign the contract to them. Then you change the buyer.
- Jenn shares how lack of access to the source prompts wholesaling.
- Not every seller wants their house to go on the market. Not every seller wants the highest amount. Sometimes they want terms, says Jenn.
- When Jenn was wholesaling, they were wholesaling short sales. Jenn explains what short sales are and how they negotiated with the bank and the seller.
- A lot of people say you cannot be a real estate agent and be a wholesaler because if you are, then you give up some fiduciary responsibility as an agent that you have. But Jenn disagrees with this. She says that as a fiduciary, she needs to do what's best for the client.
- As per Jenn, wholesaling can be less dramatic. You can have less people in your house. Some people care about that, especially since COVID.
- There are a lot of ways to sell a house. One is we go on the market and based on the data; the client can look at it too. And sometimes Jenn does the CMA with the client. So, they can literally see her thought process of how we do this, says Jenn.
- Jenn says that wholesaling is usually people that have equity in their property, like a substantial amount of equity. So maybe it's like a probate thing or they inherited the house, or the house had a lot of repairs; They have equity, but they don't have cash.
- If you are an agent that sells a lot of houses and you have all of these tool belt tools in your tool belt available, you are naturally going to be more consultative.
- As a real estate agent, you truly have to authentically care about your client and give them proper advice.
- When it comes to wholesaling you can really negotiate anything that you want. There is nothing that dictates that we have to do it in a specific way, says Jenn.
- As per Monica the current market is so good, the seller should put the house on the market because they can get more money.
- As a real estate agent and in this shift that we are experiencing and will continue to experience, Jenn thinks that we have got to continue to learn and part of learning is different strategies on how to sell a house, familiarize yourself with wholesaling, familiarize yourself with how investors decide what to buy, return on investment 1031 exchanges.
- Jenn suggests when you generate leads, have a conversation with the seller, figure out what it is that they really want and then take all the ways to sell a house and match it with that and then you then you control your income. It's the easiest way to control your income.
- As per Tiebreaker Curtis Cunningham, wholesaling is not illegal. He explains what wholesaling is and why it is not illegal.
- There are a lot of agents out there that do not wholesale and do not know what it is and what they do know about it is wrong, says Jenn.
- Curtis shares insights on the reason that a seller would prefer to wholesale it rather than put it on the open market.
- There are a lot of ways to sell a house and as real estate agents, we should understand them all and not judge because every seller's situation is different, and so to be able to present the options in a in a non-judgmental way really fulfills our fiduciary of doing what's right by the client says Jenn.

- If you know how to generate leads and you understand that there are many ways to sell a house and you take a consultative approach with the seller to find out what their needs are, what is best for them, and you have access to all the ways to sell a house you can truly do what is best for the seller.
- Jenn says that agents are having problems with disclosing. This is why the Department of Justice is coming after real estate agents because they are not disclosing how the commission works.
- As per Monica wholesaling is dangerous. She says when you are licensed, you know so much and there is room for leaving things out, either conveniently or accidentally.

- It is not always in the best interest to go to market with a house. There is this fallacy that every seller wants the highest price, and that's not true, says Jenn.
- Jenn started her career as a wholesaler and properties were starting the foreclosure process with the bank.
- There are a thousand ways to sell a house and today we sold a lot that we never put on the market, explains Jenn.
- Whether or not you should go to market with your new listing depends on what problem you are solving. If you are looking at value, Monica believes it is the smartest thing to take to the market.

- Lori had properties that she actually advertised in completely different cities and states because that property attracted those kinds of buyers, to her it doesn't really affect one way or another whether it's on the MLS in that sense.
- Lori says that it really depends not only on what the seller wants, but who is the ultimate buyer for a particular house.
- In Lori's local area they had some celebrity type people and it was the last thing that they needed was to have local exposure. The MLS sometimes limits what can be seen and shown as well.

On this episode of the Real Estate Fight Club Podcast, Jenn and Monica are going to talk about the topic: if you are a top producer, what is next for you?Today's tiebreaker is Jennifer Myers from the Agent Grad School company, a training platform for agents to have a six-figure business and have a life without a team. Tune in for all of the great information and opportunity.
Episode Highlights:
- As a real estate agent, if you have done it for several years in a row, and you are a proven talent, and this is your business, and you are producing maybe not 100 deals a year, but you're like a good 20 to 30 deals a year.
- The reason you are not having success is that you are on the wrong path. You are trying to follow someone else's way, says Monica.
- What is a top producer doing in this industry?
- Every time Monica gets to know an agent and asks what their business goal is for this year, they say something lile, ‘40 deals’; And if she asks where they got that number, they say, "I did thirty last year, so I figure I should do forty now."
- Some people think that they should be their own brokers, but they forget about their life. What do you really want? Why did they start this business?, asks Jenn.
- Monica asks Jenn, when somebody has hit that stride where they are making enough money to make themselves happy, and support their family or they are the professional real estate agent, what does she think is next for them?
- If people don't know the difference between profit and revenue, look it up because it is a humongous difference.
- Building a team talent is going to be your problem because if you bring on a buyer's agent who is a rockstar in work, he will leave you within six to twelve months because he will realize he can do this on his own, says Monica.
- People don't realize that there is an expense per person, and you have to take into account what staff you are hiring for that person, what time are you taking away from you that you would normally be generating leads because that is going to be the first thing to go.
- Some teams make more money, but you need to figure out how much you spend to make that money and how much you compromise your life.
- Monica says that if you need to stay where you are, you need to stop listening to what others are saying and ask yourself, If you are on the right path and doing more things to make money?
- Monica has a team of 149 agents, and she has zero liability around that. She is not carrying a broker's license and will not be dragged to court and lose everything because eXp is carrying that liability.
- If you make more money just from what you are already doing, that is a higher return on investment.
- Jennifer Myers, today’s tiebreaker, opened her own brokerage and teaching agent school during the recession in 2008, when Agent Grad School was born. It was originally supposed to be like the little training in her little ten-person office, but now it's across the country.
- Success always focuses on the balance between our business and life. You are allowed to be successful real estate-based agents and have a life, and you also are allowed to be a successful real estate agent and not want more or need to do more.

- You can argue the benefits of eXP, but with eXP, there is a new way to leverage. There is a new way to build a team without liability, and it rolls without the majority of the responsibility of spending a ton of money, says Monica.
- The perfect buyer's agent will produce for you. What should it look like?
- There is a new opportunity in this industry, and it's a viable, fast-growing, massive one, and the reason growing fast is that agents walk with their feet, and they go where they get to keep more money.

Should Sellers Be Available For Showings?- EP 142

On this episode of the Real Estate Fight Club Podcast, Jenn and Monica are going to duke it out over, should sellers be available for the showings, should sellers be onsite? What are the potential scenarios and problems? Tune in for all of the insights.
Episode Highlights:
- If someone has a unique property or there is a story about it, or if there will be a lot of questions, Jenn thinks it's better to have a seller at showings.
- If it's not a house that requires a conversation, then it could be more of a detriment because it sometimes hurts, and Jenn doesn't think it hurts as much as other people think.
- If we could assume that buyers and sellers are of sound mind and normal humans, and there would be an appropriate amount of sharing, an appropriate amount of explanation, and an appropriate number of commitments, then that would be safe, says Monica.
- We tell people to take their photos down off the wall because you want to present a blank pallet, says Monica.
- Many agents aren't doing buyer consults, so they don't even know their buyer, and that's why they also don't want the seller to be there.
- The buyer can like or dislike the house, and if they are intrigued and want to know about a specific thing, we as an agent need to tell the story, says Jenn.
- If it's a cookie-cutter house and everything is normal as everything else, then there is not a lot of explanation required.
- Sarah Hubbard, the tiebreaker, weighs in with her opinions.
- If there are concerns that keep appearing, agents need to address them, so as a listing agent, Sarah gives feedback to the seller whether it is good, bad, or in between.
- If the agent studies the house and knows everything about that house top-down in between, then if there are questions, they can text the seller to ask, but it does not need a seller to come there, says Sarah.
- You can write great PDFs about the working of things in your home, and it should be sent to buyers from the listing agent, not from the seller; otherwise, it becomes more about the seller, less about the buyer.
3 Key Points:
- Some houses require additional explanation. If the seller does a nice explanation video or writes a very extensive paragraph about that aspect of the home, then the listing agent prepares the agreement appropriately unless more explanation is needed.
- Jenn explains that they should do the final walkthrough because that has been helpful when the seller takes the buyer through, especially if there are particular ways to operate the pool or something like that.
- Sarah doesn't see any advantage for the seller to be present on site because it distracts the buyer and defeats the purpose of the listing agent.

On this episode of the Real Estate Fight Club Podcast, Jenn and Monica are going to duke out over whether or not escalation clauses are an effective negotiation strategy. Monica just doesn't understand how Jenn can argue against the escalation clause. Tune in now.
Episode Highlights:
- As a real estate agent, you can work on negotiation if you have a couple of offers; But once you are getting into like 5-10, twenty offers and they all have escalation clauses, it's too much.
- From a listing standpoint, Monica thinks as a real-estate agent you are selling your seller short and it's not a great strategy especially if you are the listing agent.
- Monica's experience tells her that buyers will escalate higher than they will offer and if her responsibility is to get the best offer for her sellers, then an escalation clause will yield that.
- Monica and Jenn discuss smart negotiating strategy without any escalations clauses.
- Monica shares about a time when she was the listing agent and she asked them to remove the escalation.
- Jenn’s opinion is that the escalation clause for the sellers is just too much. She wants you to tell her what you are going to pay and in the land of multiple offers, it just doesn't make sense.
- If you are from the buyer's perspective, Jenn thinks it makes sense. But if you are from the listing side, you want everybody's best and final, which is the highest offer in the escalation clause.
- Just from the seller's standpoint, Monica's argument is that it is better for you because you see more from the buyer's perspective in that case.
- As per Christy, the tiebreaker for this episode, it is not good for either the buyer or the seller to have an escalation clause. But from the buyer's perspective, the reason she doesn't think it's good is because you basically show all the cards in your hand.
- Christy explains her process and thinking in making an offer. She doesn't even want the seller to know that they qualify for more. And that's kind of what you are doing when you give an escalation clause.
- An escalation clause opens the seller up to more scrutiny from the buyer side and it gives the buyer a little bit more control.
- Escalation clauses are a double-edged sword because you are exposing yourself, says Christy.

- Monica explains that escalation clauses are a form of gambling in a way for the buyer if they are willing to take a chance.
